Kidnapping Charges in Illinois

A person is guilty of kidnapping under Illinois law if he or she knowingly confines an individual and moves the individual by force or threat of imminent force, or by deceit or enticement, to another location with the intent to secretly confine the individual against his or her will. If a child under age 13 is moved, confinement is against his or her will absent parental approval. [720 ILS 5/10-1] Kidnapping is a class 2 felony, punishable by three to seven years in prison.

Kidnapping accompanied by certain types of criminal intent or criminal conduct may give rise to a charge of aggravated kidnapping. Examples of aggravated kidnapping include kidnapping for ransom, kidnapping of a child under 13, kidnapping causing great bodily harm to the victim, kidnapping and commission of any felony upon the victim and kidnapping with the use of a firearm. [720 ILS 5/10-2] Aggravated kidnapping is generally a class X felony, punishable by six to 30 years in prison. Enhanced penalties apply for kidnapping with the use of a firearm and kidnapping with the discharge of a firearm causing great bodily harm to another person. [720 ILS 5/10-2(b)]
